These Terms of Service (“Terms”) govern your use of StackPulse (the “Service”) at stackpulse.app, operated by Alyx s. r. o. (“Alyx”, “we”, “us”). By creating an account or using the Service, you agree to these Terms. Our Privacy Policy describes how we handle personal data.
1. Who we are
StackPulse is operated by Alyx s. r. o., a company incorporated in Slovakia:
- Registered office: Závodská 2963/4, 010 01 Žilina, Slovakia
- Company ID: 56229763
- Tax ID: 2122249338
- VAT ID: SK2122249338
- Commercial Register: District Court Žilina, Section Sro, insert no. 84989/L
- Contact: info@stackpulse.app
2. The Service
StackPulse gathers the status of third-party services, such as cloud providers and SaaS tools, from their public status pages and shows it on dashboards you set up. You can publish a status page for each dashboard, and get email alerts when a service on your dashboards has an outage.
StackPulse is free. If we ever introduce paid plans, we’ll tell you in advance, and you won’t be charged unless you choose one.
3. Your account
You must be at least 16 years old and give accurate information. You’re responsible for what happens under your account and for keeping your password and sign-in methods secure. Email info@stackpulse.app if you think someone else has used your account.
4. Status information and alerts
- The status information comes from the third parties’ own status pages, which we check regularly. We don’t control those pages, and we can’t guarantee that what they say, or what we show, is accurate, complete or up to date.
- Email alerts can be delayed or fail to arrive. Don’t rely on StackPulse as your only source of information where a missed or late alert could cause harm.
- StackPulse is independent and isn’t affiliated with, endorsed or sponsored by the services it shows. Their names and logos are trademarks of their owners and are used only to identify the services.
5. Your content and status pages
You keep all rights to what you add to StackPulse, such as dashboard names and descriptions, logos, favicons and your profile photo (“your content”). You give us a non-exclusive, worldwide, royalty-free licence to store, copy and display your content only as needed to run the Service for you, including showing it on your status page when you make it public.
You’re responsible for your content and must have the right to use it, including any logos you upload. A public status page must not claim or suggest to be the official status page of a service you don’t run.
6. Acceptable use
You agree not to:
- use StackPulse to break the law or infringe anyone’s rights;
- access, or try to access, other people’s accounts or data, or parts of the Service you’re not allowed to;
- disrupt or overload the Service, or get around its rate limits or bot checks;
- create accounts automatically or in bulk;
- copy, scrape or resell the Service or its data;
- upload malware, or content that is unlawful or misleading.
7. Intellectual property
We own the Service, including its software, design and the way it compiles the status information, but not your content or third parties’ names, logos and status information. These Terms don’t give you any rights to our name or logo. If you send us feedback or suggestions, we may use them freely.
8. Availability and changes
We work to keep StackPulse running and accurate, but we don’t guarantee that it will always be available or free of errors. We may change, add or remove features. If we decide to shut StackPulse down, we’ll tell you by email at least 30 days in advance.
9. Disclaimers and limitation of liability
To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind. We aren’t liable for indirect or consequential losses, lost profits or lost data, or for losses caused by inaccurate, late or missing status information or alerts. Our total liability for all claims relating to the Service is limited to EUR 100.
Nothing in these Terms limits liability that can’t be limited by law, including for damage caused intentionally or through gross negligence, or affects your mandatory rights as a consumer.
10. Ending your account
You can stop using StackPulse at any time, and delete your account in Settings → Delete account, which also deletes your dashboards and status pages. We may suspend or close your account if you seriously or repeatedly break these Terms, or when needed to protect the Service or other people, or to comply with the law. Unless the law or security reasons prevent it, we’ll tell you why. After your account is closed, the Privacy Policy describes what happens to your data.
11. Changes to these Terms
We may update these Terms. For material changes, we’ll update the “Last updated” date and tell you by email or in the app before they take effect. If you don’t agree with the changes, you can delete your account; if you keep using StackPulse after they take effect, you accept the updated Terms.
12. Governing law and disputes
These Terms are governed by the laws of the Slovak Republic, and disputes fall under the jurisdiction of the Slovak courts. If you’re a consumer, this doesn’t take away the protection of the mandatory laws of the country where you live, or your right to go to court there.
If we can’t resolve a complaint together, consumers can also turn to an alternative dispute resolution body. In Slovakia, that’s the Slovak Trade Inspection (Slovenská obchodná inšpekcia, soi.sk).
